Conflicto aparente de jurisdicción suscitado por la Sala Penal del Tribunal Superior de Villavicencio.
La precitada autoridad judicial consideró que en el trámite de un proceso penal se planteaba un conflicto entre la jurisdicción ordinaria y la indígena cuya resolución competía a la Sala Disciplinaria del Consejo Superior de la Judicatura.
Como esta autoridad se abstuvo de resolver dicha controversia por no existir un verdadero conflicto de competencia, la Sala Penal del Tribunal Superior de Villavicencio decidió remitir el expediente a la Corte Constitucional para que resolviera lo pertinente.
La Sala Plena de la Corporación decide INHIBIRSE de resolver el aparente conflicto y enviar el expediente a su remitente, para que imparte el trámite pertinente a la actuación, con el propósito de garantizar el acceso efectivo a la administración de justicia de todas las partes.

- PRIMERO. Ante la falta de competencia para el efecto, INHIBIRSE de resolver el aparente conflicto de jurisdicción suscitado por la Sala Penal del Tribunal Superior del Distrito Judicial de Villavicencio.
- SEGUNDO. Por medio de la Secretaría General de esta Corporación, REMITIR el expediente CJU-0014 a la Sala Penal del Tribunal Superior del Distrito Judicial de Villavicencio para lo de su competencia.
- TERCERO. CONMINAR a la Sala Penal del Tribunal Superior del Distrito Judicial de Villavicencio para que imparta el trámite pertinente a la actuación, con el propósito de garantizar el acceso efectivo a la administración de justicia de todas las partes.
- CUARTO. Por intermedio de la Secretaría General de la Corporación, COMUNICAR la presente decisión a la Sala Penal del Tribunal Superior del Distrito Judicial de Villavicencio y a la Sala Jurisdiccional Disciplinaria del Consejo Superior de la Judicatura. Así mismo, SOLICITAR al Juzgado Promiscuo del Circuito de Mitú que comunique el presente auto a los sujetos procesales dentro del trámite penal correspondiente.
